First, let me say how sorry I am for the loss of your son I can only imagine how you must feel. danbospd's answer is right on the money in my jurisdiction also. We would make an arrest if the driver was intoxicated or if there were some other circumstance such as recklessly driving backwards, not just backing out of a driveway. We normally would not even issue a citation here if it didn't involve a criminal act and was just an accident. The prevailing theory behind that is that a ticket is no justice for a lost life. You need to contact the accident investigation unit of the agency working the case and let them tell you what they plan to do.
If it was an accident ya don't need to worry. If you were drinking they would arrest you on the spot.
